License and Release Form

In consideration of the opportunity to participate in the Maryland State Arts Council On-Line Visual Artists’ Registry Database (the “On-Line Registry”) administered by Maryland Art Place, I hereby grant permission and license to Maryland State Arts Council and Maryland Art Place to digitize images of my artwork and to include up to six (6) of such images (images should be updated at least once every two years) in the On-Line Registry, which will be publicly accessible by Internet connection.

Maryland Art Place may create “low resolution” digital versions of these images to conserve electronic storage space and as a possible deterrent to copyright infringement. Furthermore, I acknowledge that should I choose to digitize and upload images to the registry from my end, that the terms laid out in this agreement still apply.

I represent and warrant that I have the full and unrestricted right to grant this permission and that the works I submit to the Registry are original and do not infringe the copyright or any other proprietary right of any other person or organization.

I may terminate the license granted hereunder by written notice sent by certified mail to Maryland Art Place, Inc., 8 Market Place, Suite 100, Baltimore, MD 21202. Maryland Art Place shall delete my images from the On-Line Registry within thirty (30) days following its receipt of such notice.

Neither Maryland State Arts Council nor Maryland Art Place is under any obligation to continue to offer the On-Line Registry service, and may discontinue such service and/or delete any artwork from the On-Line Registry at any time.

I agree that neither, the State of Maryland (the “State”), Maryland State Arts Council, nor any of their officials, agents or employees, nor Maryland Art Place nor any of their officials, agents or employees shall bear any responsibility or liability for infringement of my copyright, trademarks or any other rights by third parties as a result of the availability of my artwork or contact information on the On-Line Registry, and I will indemnify and absolve Maryland Art Place, Maryland State Arts Council, the State, their officials, agents, and employees from and against all claims, suits, damages and costs arising out of or resulting from the use of the artwork and images. I shall be solely responsible for securing any copyright registrations I deem necessary to protect my rights in the artwork and images.
